Position Overview
The Associate Director, Corporate Counsel, Commercialization and Market Access is a key member of our legal team, responsible for providing legal support for various brands and related business functions. This role involves advising on a broad range of legal issues, including FDA regulations, the False Claims Act, Anti-Kickback Statute, and competition law, particularly in connection with regulatory strategies, product labeling, promotional and non-promotional activities, medical marketing strategies, and interactions with healthcare professionals, patients, and other stakeholders.


Key Responsibilities

  • Provide legal support for one or more brands and franchises, including serving as the primary legal representative on promotional and medical materials review committees.
  • Offer solutions-oriented legal advice on marketing and medical affairs strategies, promotional tactics, direct-to-consumer advertising campaigns, FDA labeling, and healthcare fraud and abuse laws.
  • Work closely with colleagues in Intellectual Property and Access to Medicines legal teams, as well as across other departments, to develop regulatory and commercialization strategies for product candidates and marketed products.
  • Proactively identify potential legal risks and communicate compliant, practical solutions that align with the company's strategic objectives.
  • Advise on commercial contracts, vendor agreements, service agreements, and consulting agreements while managing organizational risks.
  • Provide training and presentations on legal topics to business partners and other stakeholders.
  • Lead cross-functional teams and special projects that impact the department and business.
  • Stay updated on new laws, regulations, and industry trends to assess potential impacts on the organization.

Required Knowledge, Skills, and Abilities

  • Minimum of 5 years of combined in-house and/or law firm experience, with a focus on biotech or pharmaceutical industries.
  • Strong knowledge of FDA regulations, False Claims Act, Anti-Kickback Statute, HIPAA, and product liability laws.
  • Ability to thrive in a fast-paced, evolving environment and provide practical, creative solutions to complex legal issues.
  • Excellent judgment, self-motivation, and the ability to drive issues to closure.
  • Strong interpersonal skills and the ability to collaborate effectively with diverse stakeholders.
  • Proven leadership, conflict resolution, and legal advisory skills.

Required Education and Licenses

  • Juris Doctorate (J.D.) degree, licensed to practice law in the U.S.

Physical Demands

  • Periodic travel (10-20%)
  • Routinely sitting for extended periods
  • Constantly operating a computer, printer, telephone, and other office machinery

Compensation
For U.S. based candidates, the full base pay range for this role is $168,000 - $252,000. Individual compensation will depend on factors including qualifications, skills, experience, and internal equity considerations. In addition to base salary, the successful candidate may be eligible for discretionary annual bonuses, equity grants, and comprehensive benefits, including medical, dental, and vision insurance, 401k retirement savings, and flexible paid vacation.
